How we handle personal data.

This notice explains what personal data Aquantis Insurance Reinsurance Underwriting Agency and Subagency collects, why we hold it, who we share it with, and the rights you have under the General Data Protection Regulation (EU) 2016/679.

01

Who is responsible

Aquantis Insurance Reinsurance Underwriting Agency and Subagency, Archiepiskopou Makariou III Avenue 155, Proteas House, 3026 Limassol, Cyprus, is the controller of the personal data described in this notice. For any question about it, write to broking@aquantisre.com.

02

What we collect

In the ordinary course of broking we handle business contact details of the people we deal with at cedants, reinsurers and other intermediaries; the information contained in submissions, slips, wordings and endorsements; and claims information, which may include details of individuals involved in a loss.

Where a placement or a claim requires special category data — for example health information in a liability or personal accident matter — we handle it only to the extent necessary to arrange or administer the reinsurance and to establish or defend legal claims.

03

Why we hold it and on what basis

We process personal data to arrange, place and administer reinsurance, to handle claims, to manage our relationship with clients and markets, and to meet our own legal and regulatory obligations.

Our legal bases are the performance of a contract or steps taken before entering into one; compliance with a legal obligation, including anti-money-laundering, sanctions and regulatory reporting duties; and our legitimate interests in running and developing a broking business, balanced against the rights of the people concerned.

04

Who we share it with

Placing a risk means disclosing it to the market. Personal data contained in a submission may be shared with reinsurers, other brokers and intermediaries, loss adjusters, surveyors and legal advisers, and with our own IT and professional service providers, who act on our instructions.

We disclose personal data to regulators, law enforcement and other public authorities where we are required to do so.

05

Transfers outside the EEA

Reinsurance is an international market, and a placement may involve reinsurers or service providers outside the European Economic Area. Where that happens we rely on an adequacy decision of the European Commission or on the European Commission's standard contractual clauses, together with any additional safeguards the transfer requires.

06

How long we keep it

We retain placement and claims records for as long as the business relationship continues and afterwards for the period required by the applicable limitation and regulatory retention rules, which for reinsurance business is generally at least seven years from the end of the relationship or the closure of the claim, whichever is later. Records are deleted or anonymised once that period ends.

07

Your rights

You have the right to ask for a copy of the personal data we hold about you, to have inaccurate data corrected, and in defined circumstances to have data erased or its processing restricted, to object to processing carried out on the basis of our legitimate interests, and to receive certain data in a portable form.

To exercise any of these rights, write to broking@aquantisre.com. We will respond within one month; if a request is complex we may extend that period and will tell you if we do. There is no charge for a request unless it is manifestly unfounded or excessive.

08

Complaints to the supervisory authority

If you believe we have handled your personal data improperly, please raise it with us first. You also have the right to complain to the Office of the Commissioner for Personal Data Protection, 15 Kypranoros Street, 1061 Nicosia, Cyprus — commissioner@dataprotection.gov.cy.
